Mmm Mmm - Gotta Love That Pie Mold

By Mike Patrick Jr, MD Pie mold. No, it’s not the fuzzy stuff you find a week after Aunt Loretta sends you home with left-overs. Campers know what I’m talking about. Pie molds were all the rage in the Seventies–and they’re still popular today. One of my favorite childhood memories is sitting around the campfire as a kid, feeling the warmth on my face, watching the flames dance, listening to the hiss and pop of burning wood, and smelling the acrid aroma that will linger in your clothes until their next washing. In this memory, I’m holding the wooden grips of a pie mold, keeping its cooking surface just above the hot coals on the fire’s edge. The Pie Mold was our campfire cooker, and a slick one at that. On the business end, two metal plates came together, sandwiching a creation of bread and toppings. Stick it in the fire a minute or two, pull it out, open it up, and wah-lah: You had a golden-brown pie filled with pizza fixings or cherry sauce or bacon and eggs or whatever else got your stomach growling and your mouth watering. It may not have been the healthiest of meals, but remember this is camping we’re talking about. Save your salads and yogurt for home. When you’re out in the woods, you gotta live a little. There was a time I had forgotten this memory. High School and College have a tendency to erase some of your past, and for me the pie mold became a victim of that fate. I met a girl. We graduated from College, married, started a family–you know the drill. At some point in this process, I discovered something amazing: My wife’s father makes pie molds. I’m not kidding. Talk about an uncanny way of reviving a childhood memory. Soon after I made this discovery, he told me the story. Back in 1962, pie molds were around, but they were made of cast iron. The iron took forever to reach cooking temperature and it distributed heat unevenly. So instead of a golden-brown pie, you ended up with burnt crust and a lukewarm center. He had the idea that heavy-duty aluminum would work better. It would heat quickly, it would heat evenly, and it was light weight to boot. Not being a man to sit on the sidelines while another takes action, he called a foundry, invested in a pattern, and the Minute Pie Mold Company was born. As it turns out, he was right about the aluminum. The Minute Pie Mold outperformed the old cast-iron model in every way, and sales climbed as campers started using them. Upon hearing his story, I called my parents, eager to see if the pie mold of my memory was a Minute Pie Mold. How cool would that be? Well, I’m sorry to say my parents couldn’t remember. It seems their divorce had put a damper on camping memories, and since a drop-down-drag-out custody battle over gear wasn’t in the cards, that old pie mold was lost to the ages. But to this day, I firmly believe it was a Minute Pie Mold. Don’t try to convince me otherwise. So what’s my point? Well, I’m not after free advertising for the Minute Pie Mold Company (although I’m sure you’d put a smile on an old man’s face if you surf over to www.minutepiemold.com and take a peek at what I’m talking about) and I’m not trying to convince you that providence led me from an old campfire cooker to its creator’s daughter. What it does boil down to is this: Memories. If I hadn’t married the daughter of a pie mold maker, I might have forgetten those campfire memories altogether. But I did marry the daughter of a pie mold maker. I do remember the campfire memories, and I did something about them. We have a campfire ring in the backyard and a whole set of Minute Pie Molds thanks to a generous family discount. Most important of all, the kids whoop and holler when we light a fire and break out the molds. They love pie mold nights. They’re forming their own campfire memories, ones they will someday share with their children. What childhood memories have you forgotten? Don’t answer now. You can’t. Afterall, they’re forgotten. But if you slow down and pay attention, something will come back to you. And when it does, don’t ignore it. Let it come back. Hold on to it. Remember it. Value of Toxic Injury Cases Compared to Workers’ Compensation Claims

By Raphael Metzger While monetary recovery is limited in workers’ compensation (and has been even further limited by recent legislation), monetary recovery in the third party case can be substantial. Unlike the meager benefits available as workers’ compensation, injured workers have the potential of recovering substantial verdicts and settlements in their third party cases. Damages for pain and suffering are available and juries often render verdicts in seven figures for such noneconomic damages. In extraordinary cases, punitive damages may also be recoverable. Of course, workers who prove their cases to the satisfaction of juries are also entitled to past and future medical expenses, as well as past and future lost wages or lost earning capacity. It is therefore not surprising that meritorious third party toxic injury cases often settle in six and seven figures. Not all toxic injury cases are worth seven figures. A workers’ damages are reduced by his own proportionate fault and that of his employer. If the worker got leukemia from occupational exposure to benzene, but most of his benzene exposure came from smoking cigarettes, the worker would only be entitled to that percentage of his damages attributable to the percentage of his occupational benzene exposure. However, in practice juries these days rarely find in favor of a worker whose cancer can be attributed even in part to smoking, alcohol, or recreational drugs. Equally problematic is the case of the worker whose occupational disease was primarily caused by an employer’s gross negligence. In such cases, the worker may, however, have a meritorious serious and wilful claim in workers’ compensation. Regarding S&W claims, if the worker has a decent third party case, you should not file a S&W claim against the employer, because it can be introduced as evidence against the worker in the third party case. If the jury’s verdict is for the plaintiff for $1 million, but the jury finds that the employer was 95% at fault for causing the worker’s injuries, the worker only recovers $50,000. So carefully consider whether you should file that S&W claim! Since so many workers suffer from occupational diseases and toxic injury cases can result in large settlements and verdicts, why haven’t you heard all that much about these cases? With the exception of asbestos-related disease, few law firms litigate such cases on a third party basis, for several reasons. The cases are extremely complex and difficult, primarily because the third party attorney must not only prove that the defendant was negligent or sold a defective chemical product, but that exposure to the chemical actually caused the worker’s disease. It can be very difficult to prove that a worker’s cancer occurring thirty or more years after occupational exposure to a chemical was caused by that chemical. Proving causation in toxic injury cases can also be very costly. Costs in these cases typically run into six figures. Why? Many experts are necessary: a pathologist (to accurately diagnose the disease), a toxicologist (to explain the toxic effects of the chemical), an industrial hygienist (to quantify the worker’s exposure to the chemical), a chemical engineer (to establish that the chemical is a defective product), an epidemiologist (to testify that workers exposed to the chemical develop the disease the plaintiff has at a significantly greater rate than those not exposed), an occupational medicine physician or medical toxicologist (to opine that exposure to the chemical caused the worker’s disease based upon all the evidence and by ruling out alternative causes), a life care planner (to determine the cost of the worker’s medical care), and an economist (to determine lost wages, lost home services, and to reduce the future losses to present value). Given the difficulty of proving the case, the specialized knowledge of science and medicine required, the problem of employer and worker comparative fault, and the huge costs of bringing the case, few firms choose to litigate toxic injury cases (except for asbestos cases). For these reasons, don’t expect the usual one-third referral fee for such cases. Most firms that litigate toxic injury cases will pay referral fees between 15% and 25% after deduction of costs. A Christian Man Speaks Out

By Greg Cryns Back in 1960 John F. Kennedy was forced to tell the nation that he would not allow the Pope to intervene in Amercian politics. Some people were very concerned that the U.S. would be run by Catholics because Kennedy was Catholic. I think the U.S. is now being run by political Christians. I am concerned about that. My research shows that in 2001, 80% of the citizens in the U.S. called themselves “Christian” by religion. There were 5% who were in all of the “other religions” combined and a whopping 15% who called themselves No Religion/Atheist/Agnostic, up from 8% in 1990. We have a President who said he consults with his Christian God about political matters. We have groups called Christian Coalition, Concerned Women for America, Focus on the Family, People for the American Way, Traditional Values Coalition and at least seven other major Christian political groups as shown here: http://www.csuchico.edu/~kcfount/christian.html In addition, we have people telling us that the country was founded on Christian ideals and Christian philosophy. As a member of my local library’s board of trustees I have born again type Christians trying to rip into the fabric of free speech that has taken over 200 years to ferment and I have the Concerned Women for America sending threatening letters to the board. I have Christian individuals and Christian organizations telling me that the schools should allow prayer in public schools and that the schools should be allowed to put up Nativity scenes. We have Christians telling the husband of a dying woman he cannot honor his wife’s wishes to pull the plug, that he was lying about her wishes, that the poor weeping Catholics and their priests ouside the hospital should sway the judge to continue her vegetative life. We have a President whose campaign manager admittedly went after the Christians to swing the election and afterwards Rove said without them the Reps would have lost. And to get their vote Rove and Bush would leave no stone unturned. We have a new breed of Christian pastors who use the pulpit to get out the vote. This includes one “Pastor Russell Johnson paces across the broad stage as he decries the ’secular jihadists’ who have ‘hijacked’ America, accuses the public schools of neglecting to teach that Hitler was “an avid evolutionist” and links abortion to children who murder their parents.” http://www.usatoday.com/news/washington/2005-08-02-christian-cover_x.htm There are Christians who are totally pissed off because the grade schools will not teach Creationism in the science curricula. We have very powerful Christian leaders who even Christians admint are just plain NUTS. Jerry Falwell, Jim & Tammy Baker, Pat Robertson. Then we have a list of preachers who are just goofy: Charles Stanley , Joel Osteen, Robert Schuller, Jimmy Swaggart. Who did I leave out? These men march around the stage spewing the most incredible and unprovable messages ever heard by the ears of man, and people lap it up. Here is something that boggles the mind: “Less than two years after it was plunged into a rape scandal, the Air Force Academy is scrambling to address complaints that evangelical Christians wield so much influence at the school that anti-Semitism and other forms of religious harassment have become pervasive. Dear Christian brothers and sisters. I think most real Christians in the U.S. are tired of the ranting of those who want to capture power in America. Please be concerned about your own spirituality. Kindly do not tell me how I SHOULD live and think. Keep your prying beliefs to yourself. Most of all, I would appreciate it if you would stop using the name of Jesus to influence voters in America. All By Myself… Don’t Want To Be

By Annie Kaszina Today I spoke to a woman whose marriage has ended after 30+ years. She was, she said, trying to remain positive. She was also terribly worried about the prospect of spending the rest of her life alone. It sounded as though she envisaged eking out her future, entirely alone, marooned on a desert island somewhere. Her only hope of rescue from this island was, of course, if a new partner appeared on the horizon. Now, the reality is that this woman lives in a town, with good communications, has some family around her, knows quite a lot of people and leads a fairly active life. She has interests and hobbies and plenty of personal resources. Her mind-set is far more persuasive than her reality. She went on to tell me that her husband never listened to her or paid any real attention to her wants, needs and wishes. Like many other women of her age whose marriage finally founders, she had, she said, lost her voice. She had had to defer to her husband for years on end. Her husband had made her feel small, stupid and inadequate. He was, she said, a strong personality; while she is sensitive. That, of course, is one interpretation. She was too loyal, whether to her husband or her idealised view of her marriage its hard to say, to see that he might also be domineering, pig-headed, overbearing, controlling, careless of her feelings, or emotionally abusive. The way she described him, and she wasnt fishing for sympathy, she made him sound like extremely hard work. He shared none of her tastes and valued nothing that mattered to her. He spent years intimating to her that she was, essentially, worthless. Still, he had stayed with this allegedly worthless woman, until she tried to redefine her role in the marriage. And yet she still believes that life as one half of a couple (if, indeed, she could even correctly be termed an equal half of any unit which couples her with her husband) is better than life alone. Alone is the killer word. It implies a damning social judgement. We are still led to believe that women who are alone are social and personal failures. Societys misfits. They are the socially handicapped, carefully excluded from right-thinking mixed society. Outcasts from coupledom. (Which might just make Internet dating the new French Foreign Legion!) In fact, this womans issues around her own self-worth have blinded her to the reality. More people including, obviously, women than ever before are living, and choosing to live, uncoupled lives. They find pleasure and meaning in their life. She knew that she could never find pleasure and meaning in her future alone. She could get herself a place, decorate and furnish it to be exactly the way she wanted it to be, but still she would be alone and it would all be worthless. Until I asked her what would happen if she replaced the term alone with the phrase stepping into my own life. That phrase stopped her in her tracks for a moment. She replied: Well yes, maybe. But when I asked her to try the phrase in her own mouth something interesting happened. As she said it her mood lifted and there was a new energy and conviction in her voice. For many women there are only two points of reference: either with a partner - which usually means deferring to a partner or alone. The self doesnt fit anywhere into that equation. My client had lost a neglectful husband, but found the path to her own self. Which will offer her more fulfilment? Well, your guess is as valid as mine. It all depends, in the end on your viewpoint. She can return to her conditioned, traditional viewpoint if she chooses, and endure all the feelings of worthlessness that it comprises. Or she can embrace the forward looking, life affirming choice.
